Introduction

A-Vision Software, (we, us, our) complies with the regular Privacy Acts when dealing with personal information.  Personal information is information about an identified or identifiable individual (a natural person).

This policy sets out how we will collect, use, disclose and protect your personal information.

Changes to this policy

We may change this policy by uploading a revised policy onto the website.  The change will apply from the date that we upload the revised policy.

Personal information we collect and who we collect it from:

Where you or your company is a user of our services, we collect the following general types of information, which may include personal information:

  • general user and account-related information which may include your name, company, e-mail address, phone number (including mobile phone number), location, GST number and other information necessary for us to provide the services that you or your company request
  • information that you store using, or otherwise input into, our services in the course of using those services (Client Content)
  • behavioural information, including information collected via cookies and other methods, about how users interact with our online services (for more information, see the section below-titled Cookies).

We collect personal information about you from:

  • you, when you provide that personal information to us, including through any registration or subscription process, through any contact with us (e.g. phone call or email), or when you buy or use our services
  • third parties where you have authorised this or the information is publicly available. If possible, we will collect personal information from you directly
  • our clients who are using our services to store and/or process content which includes personal information about you.

How we use your personal information

Where you or your company are a user of our services, we will use your personal information:

  • to verify your identity (if necessary) e.g. for billing purposes]
  • to provide our services to you or your company
  • to market our services and products to you, including contacting you electronically (e.g. by text or email for this purpose)
  • to monitor, maintain and improve the services that we provide to you, including to improve your user experience, and on an aggregate and anonymised basis to improve the services that we provide to other users
  • to undertake credit checks of you (if necessary)
  • to bill you and to collect money that you owe us, including authorising and processing credit card transactions
  • to respond to communications from you, including a complaint
  • to conduct research and statistical analysis (on an anonymised basis)
  • to protect and/or enforce our legal rights and interests, including defending any claim
  • for any other purpose authorised by you or the law.

Where a client of ours uses our services to store and/or process Client Content which contains personal information about you, that person will have its own policies on how it handles personal information.  You should contact that person in the first instance for any queries you may have about the collection, storage and use of your personal information.  It is a requirement under our standard terms and conditions that our clients do not use our services to store credit card information.

Except where we are required at law to retain information for longer periods, we will not retain personal information for longer than necessary to fulfil the purposes for which it was collected.

Disclosing your personal information

Generally, we do not disclose personal information about you to third parties, except to:

  • another company within our group, where reasonably necessary to carry out the purposes set out in this privacy policy
  • to third parties (e.g. Xero, Dropbox) with whose applications our systems communicate and share information via APIs, in the ordinary course of the operation when we provide our services to you
  • to our third-party service providers who provide us with hosting and data storage services, to the extent necessary for them to provide us with those services (see further information set out in the section titled Protecting Your Personal Information, Storage and International Transfer)
  • to other third-party service providers who provide us with support and maintenance services, to the extent necessary for them to provide us with those services
  • a credit reference agency for the purpose of credit checking you
  • other third parties (for anonymised statistical information)
  • a person who can require us to supply your personal information (e.g. a regulatory authority)
  • any other person authorised by applicable privacy laws or another law (e.g. a law enforcement agency)
  • any other person authorised by you.

We do not sell your personal information.

Protecting your personal information, Storage and International Transfer:

We will take reasonable steps to keep your personal information safe from loss, unauthorised activity, and other misuses Including firewalls on our servers, encrypted logins, encrypted data connections, and daily data backups.

Any personal information we store may be stored on our servers and the servers of our trusted third-party service providers in New Zealand, Australia and/or Europe.  E.g., we currently use Amazon Web Services for data storage services, with servers based in Australia and Europe.  For more information on how Amazon Web Services handles and protects personal information see http://aws.amazon.com/privacy.

Where we use third-party service providers, we use only reputable providers who we consider have appropriate levels of protection for information being stored and processed using our services.

Internet use

While we take reasonable steps to maintain secure internet connections, if you provide us with personal information over the internet, the provision of that information is at your own risk.  You acknowledge that no system is completely secure and that our obligations do not provide a guarantee that any information, including personal information, will be 100% secure against unauthorised access or loss (including hacking).

If you follow a link on our website to another site, the owner of that site will have its own privacy policy relating to your personal information.  We suggest you review that site’s privacy policy before you provide personal information.

COOKIES

We use cookies (an alphanumeric identifier that we transfer to your computer’s hard drive so that we can recognise your browser) [and other methods such as web beacons] to monitor your use of our services, and for us to generate the information that we process and provide as part of our services.  We use Google Analytics, an analytics and marketing tool, to help us collect this information.  For more information on how Google Analytics handles data see www.google.com/policies/privacy/partners/].

You may disable cookies by changing the settings on your browser, although this may mean that you or (where your company is the user of our services) your company cannot use all of the features of the relevant service.

ELECTRONIC MARKETING

Where you have opted to receive marketing information, provided us with your contact details for general account purposes, or otherwise consented to receive marketing information, we will use your contact information to let you know about our services and related information, which we think you may be interested in.  We may contact you electronically (e.g. by email or by text) for this purpose.

Accessing and correcting your personal information

Where our services enable you to access and correct information directly, you may access and correct that information.

Subject to certain grounds for refusal set out in any applicable privacy laws, you have the right to access your readily retrievable personal information that we hold about you and to request a correction to your personal information.  Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.

In respect of a request for correction, if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction.  If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction.

Where we are permitted at law to do so, we may charge you our reasonable costs of providing to you copies of your personal information or correcting that information.
